                MINUTES:

                Monday, September 10, 2007 – Regular & Executive Sessions:

The minutes were amended to reflect under Communications & Correspondence under the topic School Concerns; the words: were interviewed in the second to last sentence were removed and replaced with the wording: was discussed.

Motion made by Selectman Taylor to approve the Regular and Executive Session minutes of Monday, September 10, 2007 as amended.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  4-0.

Monday, September 17, 2007 Regular Session:

Motion made by Selectman Green to approve the Regular Session minutes of Monday, September 17, 2007 as presented.
Motion seconded by Selectman Taylor.
VOTE:  Unanimous.  4-0.

                OLD BUSINESS:

                Application for License – Beer/Wine License for Oktoberfest:

Kevin Shackett was in attendance to request the Selectmen approve the annual application of the Mashpee Chamber of Commerce to sell beer/wine at the Mashpee Oktoberfest on Saturday, October 6, 2007 with a rain date of Sunday, October 7, 2007.  The event is scheduled to be held in Mashpee Commons at the Village Park located at the intersection of Steeple Street and Jobs Fishing Road.

Motion made by Selectman Green to approve the one-day liquor license (beer/wine) of the Mashpee Chamber of Commerce for the Mashpee Oktoberfest to be held on Saturday, October 6, 2007 with a rain date of October 7, 2007.
Motion seconded by Selectman Cahalane.
VOTE:  Unanimous.  4-0.

Special Events Application – Oktoberfest 10K Road Race:

An application was before the Selectmen for approval of the first Mashpee Oktoberfest 10K Road Race to be held on Saturday, October 6, 2007.  Gus Frederick, Director of Leisure Services was present to discuss the special events application with the Board of Selectmen.  An updated map detailing the road race route was distributed.  The race is intended to begin on Great Oak Road at the South Cape Beach (Town) parking lot to the finish line on Job’s Fishing Road for the awards ceremony.  Three police detail personnel and thirty volunteers will be on hand for public safety purposes.

Motion made by Selectman Cahalane to approve the Mashpee Oktoberfest 10K Road Race on Saturday, October 6, 2007.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  4-0.

APPOINTMENTS AND HEARINGS:

Senior Tax Abatement Program Update:

James Long, Council on Aging Director was in attendance to recommend the Board approve the Property Tax Abatement Program for eligible Senior Mashpee taxpayers seeking tax relief.  The program assists seniors in the payment of property tax bills through an abatement payment for volunteer services rendered to the Town.  Funds for the program derive from the overlay account.
                
Last program year, the Town appropriated $18,000 for thirty participants.  During the October 1, 2006 through September 30, 2007 period, fifty-seven individuals applied for the senior tax abatement program.  It was noted the maximum abatement is $600 per tax year per household and successful candidates must complete 89 hours of service for eligibility.  

Motion made by Selectman Taylor to approve the Senior Property Tax Abatement Program from October 1, 2007 through September 2008 allowing (30) participants.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  4-0.

Due to the large number of applicants, the Selectmen agreed to request input from the Finance Committee regarding the possible expansion of the program.  The matter will be placed on the Selectmen’s agenda of October 1, 2007 for additional review.
                APPOINTMENTS AND HEARINGS:

Public Hearing (cont’d from September 10, 2007) – Finally Dino’s:

The Board of Selectmen opened the Public Hearing continued on the annual liquor license renewal of Barnstable Pizza & Pasta Co., Inc. d/b/a Finally Dino’s, Constantinos Mitrokostas, Manager regarding the matter of compliance was it relates to the Massachusetts Fire Safety Act requiring automated sprinkler systems by the date of November 15, 2007.

The Hearing notice was read aloud in accordance with posting requirements.  Dino Mitrokostas met before the Board to discuss the progress of the sprinkler system installation at Finally Dino’s and Dino’s Sports Bar.  To date the project is on schedule to adhere to the issue of fire safety compliance.

Correspondence was received from George Baker; Fire Chief dated September 20, 2007 regarding the status of the fire sprinkler system.  Chief Baker was in attendance and was noted to be in agreement with the progress of the sprinkler system installation.  An informal inspection was conducted by the Chief on this date.  Sprinkler heads are visible in the ceiling and piping is present in the basement.  The sprinkler valve has not been installed and it was noted the street line or flush line has not been tested or certified to date.  However, the project is on schedule for compliance.

Being no public comment, the Board motioned to continue the Hearing.

Motion made by Selectman Cahalane to continue the Public Hearing of Finally Dino’s to November 15, 2007.
Motion seconded by Selectman Taylor.
VOTE:  Unanimous.  4-0.



APPOINTMENTS AND HEARINGS:

DPW Director – Pavement Management Update – (VHB):

Representatives from Vanasse Hangen Brustlin (VHB) gave an overview of pavement management conditions and recommendations for the Town of Mashpee.  Pavement management is the practice of planning for pavement maintenance and rehabilitation with the goal of maximizing the value and life of a pavement network.  

Routine and preventative maintenance practices have helped to preserve roads in the Town of Mashpee.  It was noted the pavement management system of conditions is presently being integrated with the Town’s GIS.

Recommendations to maintain current conditions incorporate $460,000 Chapter 90 annual funding and an annual road budget of $700,000.  The assessed value of current pavement in the Town of Mashpee is $33.8 million. The current pavement backlog is estimated at $1.2 million to bring forth a total network value of $35 million.

The Selectmen agreed to remit a copy of the Pavement Management Update to the Finance Committee for review.

NEW BUSINESS:

One Room School House Discussion:

Frank Lord, President of the Mashpee One-Room Schoolhouse Preservation Council (MOSPC), a non-profit “Friends” group was in attendance to recommend the Selectmen move the Schoolhouse to Town owned land adjacent to the Mashpee Archives building.  

The benefits of the move from the Old Indian Cemetery to the Mashpee Community Park were considered.  The goals of the MOSPC) are to open the Schoolhouse for historical tours conducted by trained volunteers for the benefit of Mashpee students as an integral part of school curriculum, for Mashpee families and individuals, off-Cape tourists and residents from other Cape towns.  If the move were approved, the Town-owned Schoolhouse would lie within the boundaries of the proposed Mashpee Historic District.

Objectives to be met for the 176 year old building include the restoration of the Schoolhouse with $16,500 attained CPA grant funding.  To date, a Ben Franklin period stove has been purchased with CPA funding.  A major objective to be met by September 1, 2008 is the development of a program with the Mashpee School Department for historical tours of the One Room Schoolhouse and Mashpee Archives for elementary and secondary students.  It was noted the Mashpee Wampanoag Indian Tribal Council has not expressed an interest in obtaining the Schoolhouse to date.  

The cost of moving the Schoolhouse which is listed in the National Register of Historic Places has not been determined.  The use of CPA funds was considered as a revenue source to move the building.  The deadline for applications to the Community Preservation Committee for funding consideration at the May 2008 Special Town Meeting is November 1, 2007.

Motion made by Selectman Taylor to approve the move of the One Room Schoolhouse to the Mashpee Community Park also known as The Collins Lot next to the Archives Building.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  4-0.

                Request for Reappointment – Historical Commission:

The Selectmen were requested to reappoint Gordon Peters to the Historical Commission as a result of an omission in the list of annual reappointments approved by the Board this past June.

Motion made by Selectman Taylor to reappoint Gordon Peters to the Historical Commission for a term to expire June 30, 2009.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  4-0.

Proclamation – United Nations Day:

October 24, 2007 marks the 62nd anniversary of the United Nations.  Since 1947, every U.S. President has issued a proclamation asking citizens to observe this special occasion.

Motion made by Selectman Taylor to support and proclaim October 24, 2007 as United Nations Day.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  4-0.

Letter of Support for Falmouth’s Grant Application to County Water Protection Collaborative:

The Town of Falmouth is requesting the County Water Protection Collaborative for a grant to have groundwater modeling done for a potential treated wastewater discharge area at the Falmouth County Club property, which is a recharge area for Waquoit Bay.  The Mashpee Board of Selectmen were asked to provide a letter of support for the grant project entitled Groundwater Modeling to Evaluate a Wastewater Management Alternative for the Shared Waquoit Bay Watershed.

Motion made by Selectman Cahalane to send a letter of support on behalf of the Town of Falmouth’s grant application.
Motion seconded by Selectman Taylor.
VOTE:  Unanimous.  4-0.
